1. Acceptance of Terms
By accessing, browsing, registering on, or using the VelunaLinks platform in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and VelunaLinks. If you do not agree with any part of these Terms, you must immediately discontinue all use of the platform. VelunaLinks reserves the right to modify, update, supplement, or replace these Terms at any time and for any reason. Changes will be effective immediately upon posting to the platform. Your continued use of the platform after any modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically to stay informed of any updates. These Terms apply to all users of the platform, including without limitation users who are browsers, visitors, registered account holders, creators, contributors, and any other person who accesses or uses the platform in any manner.
2. Eligibility
You must be at least eighteen (18) years of age to use the VelunaLinks platform. By using the platform, you represent and warrant that you are at least eighteen years old, that you have the legal capacity to enter into a binding agreement, and that your use of the platform does not violate any applicable law or regulation in your jurisdiction. VelunaLinks reserves the right to request proof of age at any time and to terminate or suspend any account if there is reasonable belief that the account holder does not meet the minimum age requirement. If you are using the platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. VelunaLinks does not knowingly provide services to individuals under the age of eighteen, and any account found to be operated by a minor will be terminated immediately without notice.
3. Account Registration and Responsibilities
To access certain features of the platform, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activities that occur under your account, whether or not authorized by you. You agree to notify VelunaLinks immediately of any unauthorized use of your account or any other breach of security of which you become aware. VelunaLinks shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. You may not transfer, sell, assign, or otherwise convey your account to any other person or entity without the prior written consent of VelunaLinks. VelunaLinks reserves the right to disable, suspend, or terminate any account at any time and for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or extended periods of inactivity, with or without prior notice.
4. Permitted Use and Content Guidelines
VelunaLinks provides a platform for creators to build and customize personal link-in-bio pages. You may use the platform only for its intended purpose and in compliance with these Terms and all applicable laws and regulations. You retain ownership of all content you submit, post, or display on the platform, including but not limited to text, images, links, biographical information, and any other materials. By submitting content to the platform, you grant VelunaLinks a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the platform's services. This license terminates when you delete your content or your account, except for content that has been shared with other users or made publicly available, and except for reasonable backup copies that may persist for a limited period in our systems. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to submit all content you post on the platform, and that your content does not infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party.
5. Prohibited Conduct
You agree not to use the platform for any purpose that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable as determined by VelunaLinks in its sole discretion. Without limiting the foregoing, you agree not to: impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; upload, post, or transmit any content that you do not have a right to make available under any law or contractual or fiduciary relationship; upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, chain letters, pyramid schemes, or any other form of solicitation; interfere with or disrupt the platform or servers or networks connected to the platform; use any robot, spider, scraper, or other automated means to access the platform for any purpose without our express written permission; attempt to gain unauthorized access to any portion of the platform, other accounts, computer systems, or networks connected to the platform through hacking, password mining, or any other means; collect or store personal data about other users without their express consent; or engage in any activity that could disable, overburden, damage, or impair the platform or interfere with any other party's use of the platform.
6. Identity Verification and Verified Badges
VelunaLinks offers an optional identity verification service through which creators may obtain a verified badge displayed on their profile. The verified badge indicates that the creator has completed a one-time identity confirmation process and has been determined to be a legitimate, authentic individual. The verification process involves the submission of a valid government-issued identification document for the sole purpose of confirming the applicant's identity. VelunaLinks does not store, retain, copy, or preserve the identification document or any information derived from it beyond the immediate moment of verification. Upon completion of the verification process, the document and all associated data are immediately and permanently deleted from all systems. The verified badge serves solely as an indicator that verification was completed and does not constitute an endorsement, guarantee, or warranty of any kind regarding the verified user's character, conduct, content, products, or services. VelunaLinks reserves the right to revoke any verified badge at any time for any reason, including violation of these Terms, without liability or obligation to provide compensation or explanation. Creators who have completed the verification process have voluntarily demonstrated their commitment to authenticity and transparency by proving their real-world identity through this rigorous process, thereby providing visitors with a meaningful and credible signal of legitimacy and trustworthiness.
7. Cryptocurrency Payments
The VelunaLinks platform may facilitate cryptocurrency-based payments for certain features, services, or subscriptions. All cryptocurrency transactions are processed on their respective blockchain networks and are subject to the terms, conditions, fees, and characteristics inherent to those networks. VelunaLinks does not control, operate, or manage any blockchain network and is not responsible for network congestion, transaction delays, failed transactions, fluctuations in cryptocurrency value, or any other issues related to blockchain network performance. Cryptocurrency payments are final and non-refundable once confirmed on the blockchain, except as may be required by applicable law or as expressly stated in a separate refund policy. You are solely responsible for ensuring the accuracy of all transaction details, including wallet addresses, amounts, and network selection. VelunaLinks shall not be liable for any loss of funds resulting from incorrect transaction details, user error, or blockchain network issues. VelunaLinks never collects, requests, stores, or has access to your cryptocurrency private keys, seed phrases, or wallet recovery credentials under any circumstances.
8. Intellectual Property
The VelunaLinks platform, including but not limited to its design, layout, look, appearance, graphics, logos, trademarks, service marks, trade names, software, code, algorithms, databases, and all other intellectual property contained therein, is owned by or licensed to VelunaLinks and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. You may not copy, modify, distribute, sell, lease, license, reverse engineer, decompile, disassemble, or create derivative works based on the platform or any part thereof without the express prior written consent of VelunaLinks. The VelunaLinks name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of VelunaLinks. You may not use such marks without the prior written permission of VelunaLinks. Nothing in these Terms grants you any right, title, or interest in or to the platform or any VelunaLinks intellectual property, except for the limited right to use the platform in accordance with these Terms.
9. Third-Party Links and Services
The platform may contain links to third-party websites, services, or resources that are not owned or controlled by VelunaLinks. VelunaLinks has no control over, and assumes no responsibility for, the content, privacy policies, terms of service, practices, or availability of any third-party websites or services. The inclusion of any link on the platform does not imply endorsement, recommendation, or approval by VelunaLinks of the linked website or its operators. You acknowledge and agree that VelunaLinks shall not be responsible or liable, directly or indirectly, for any damage, loss, or harm caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit or interact with.
10. Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. VelunaLinks does not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. VelunaLinks does not warrant the accuracy, completeness, reliability, or timeliness of any information, content, or materials available on or through the platform. You use the platform at your own risk and discretion, and you are solely responsible for any damage to your computer system, mobile device, or loss of data that results from your use of the platform. No advice or information, whether oral or written, obtained from VelunaLinks or through the platform shall create any warranty not expressly stated in these Terms.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall VelunaLinks, its owners, operators, officers, directors, employees, agents, affiliates, subsidiaries, successors, or assigns be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use the platform, any unauthorized access to or use of our servers or any personal information stored therein, any interruption or cessation of transmission to or from the platform, any bugs, viruses, trojan horses, or similar harmful code that may be transmitted to or through the platform, or any errors or omissions in any content or materials available on or through the platform, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, and whether or not VelunaLinks has been advised of the possibility of such damages. In no event shall the total aggregate liability of VelunaLinks to you for all claims arising out of or relating to the use of the platform exceed the amount you have paid to VelunaLinks, if any, during the twelve (12) months immediately preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless VelunaLinks, its owners, operators, officers, directors, employees, agents, affiliates, subsidiaries, successors, and assigns from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with: your use of or access to the platform; your violation of these Terms or any applicable law, regulation, or third-party right; your content or any content submitted through your account; any misrepresentation made by you; or any dispute between you and any third party. VelunaLinks reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
13. Termination
VelunaLinks reserves the right to suspend, disable, or terminate your account and access to the platform at any time and for any reason, with or without cause and with or without notice, including but not limited to your violation of these Terms. Upon termination, your right to use the platform will immediately cease, and VelunaLinks may delete your account and all associated content, data, and information. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability. You may terminate your account at any time by contacting VelunaLinks at the email address provided in these Terms or through account management tools available on the platform. Termination of your account does not relieve you of any obligations incurred prior to termination.
14. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to these Terms or the platform shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which VelunaLinks is established, without regard to its conflict of law principles. Any legal action, suit, or proceeding related to these Terms shall be brought exclusively in the courts of competent jurisdiction in the applicable jurisdiction, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts. The parties agree that any dispute shall first be attempted to be resolved through good faith negotiation before resorting to formal legal proceedings.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent to the greatest extent possible.
16. Entire Agreement
These Terms of Service, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and VelunaLinks with respect to your use of the platform and supersede all prior or contemporaneous communications, representations, agreements, and understandings, whether oral or written, between you and VelunaLinks regarding the subject matter hereof. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and VelunaLinks' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
